If the driver cannot be identified, the holder of the vehicle, who will otherwise receive the charge, can easily claim (and win) that he was not driving at the time.
If you mean a bigger fine and 6 points rather than 3 (in the UK) if you do not tell who was driving - yes I'd say in this instance that German laws are superior.

Eh? They can't fine you when you say you don't know who was driving, BUT they can oblige you to keep account with a driver's log, so the next time you are caught you have to tell them.
