I think we actually allow this in Germany if there is a danger of a serious crime ahead, like terrorism or a large drug move...
Fellow Germans, please correct me, I'm not sure on this...

But they tape everything anyway via the Echelon System.. Or has Sam Fisher lied to me about this???

yep, you need a judge's approval before you can tap anyone here and certain groups like clergymen, doctors, lawyers, journalists and members of parliament are exempt.

In the United States we have this document called the Bill of Rights, which is the first 10 ammendments to the US Constitution.

Ammendment IV states:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
It is upon this that the judge based his ruling. He's not saying you can't tap the phones, but you do have to have a warrant. To get a warrant you go to the judge with enough evidence for reasonable suspicion and he issues a warrant making the wire-tap legal. This is part of the checks and balances built into our government to keep any one branch from becoming too powerful. It's the role of the Judicial branch to oversee this sort of thing through the issuing of warrants. Any evidence obtained illegally is not admissible in court.

Bush can say the wiretapping program in legal all he wants, but it's the Judicial branch that interprets the law. His word isn't worth anything until a judge sides with him.

depends on what kind of doctor...its only about the "ärztliche schweigepflicht". so if you're going to be a doctor of the physics, they will still tap you when you construct those nuclear bombs. images/smilies/wink.gif
