Maybe I misunderstood. But I do think it is the wife's fault. Perhaps the husband (by law) shouldn't have fired his weapon if the person was leaving, but if he was under the impression that the guy tried to rape his wife?

Yeah, as far as I can tell the wife did not wish her husband to think that she was cheating on him so she tried to make it look like she was raped. And her husband (understandably, in my opinion) opened fire on the man that was "raping" his wife and killed him.

I don't see a problem with him opening fire on the guy.

1.) He was on his property
2.) He was defending his wife (in his mind) from a violent crime. A very high percentage of rapes turn to murder.

So, I felt it was justified for what he believed to be going on. Wife has the most fault in this as was found. Seems like an unfortunate accident, she should serve some time but not the max.

Agree with the consensus........ husband was only doing right.

Of course, this is Texas...... many other places these days you're not allowed to defend yourself or your property (not saying "wife" is property) so crying "rape" in this case is a sure, um, fire way of getting a person killed especially as she should have known there was a gun at home. Well, it is Texas after all.

In Massachusetts, use of deadly force is justified only if there is a direct threat upon your life of the life of a family member. So if you wake up at night and see a burglar running away with all your stuff, you are not allowed to open fire because he is not threatening you. If, on the other hand, he is running at you with a knife, then go right ahead and pop him. Extremely stupid, if you ask me. If some a-hole is on my property and is breaking the law (eg stealing) I should be allowed to open fire.

Indeed.

If she had gotten away with cheating on him, while he got put behind bars for killing a man that he thought was hurting her, then there would have been an even bigger outcry about "justice served".

Yea, the husband should have tried to shoot the lover in the leg or arm ... as he was speeding off in a car images/smilies/lol.gif. If I thought someone was trying to rape my girlfriend, I wouldn't stop shooting until I ran out of bullets.

Well no, but being on your property while committing a violent crime against someone is cause enough to shoot. Of course it is moot because you should have just cause to shoot anyone committing a violent crime regardless of whether they're on your property or not. But stop taking it out of context I didn't say he could shoot him because he was just on his property...

I would do terrible terrible things that would probably land me in jail for a long long time. A friend of mine once spent a night in a polish prison (for graffiti) and the guys he was locked up with told him that in poland if a man goes to jail for rape or child molestation, he does not come out.
