Cool little car! Shame about the idiot driver... I really hate people who cause accidents out of their own stupidity and then don't own up to it... but your insurance is going to take care of it?

YES!

Most girls don´t care about cars AT ALL, much less know about them and spend money on it. With a few exceptions, girls I´ve met so far treat a car as "a machine in which I sit on and it takes me places".

Sweet car, I like what youve done to it, looks cool. Quite a nice design for a small car, except maybe the rear could have a bit more of a dynamic shape.
Anyway I wanted to ask, what do you mean your car on the billboard ? How does that work, you take it in for a checkup one day and they ask you if they can take pics and put it up on a billboard ?
Oh and how did you manage to ruin the rims on the left side of the car since the curb is on the right side ? Was that much damage done just from the impact ?

$6700 to fix my car in to working condition. Luckily I pay NOTHING since the other driver is 100% at fault. My car will be in the shop for 3 weeks. Come to think of it.. State Farm (her insurance) may not want to pay for the repairs AND paying for my rental car, which I don't even know if they will or not. My insurance doesn't have that option for having a rental car covered, so.. fuck. images/smilies/cry.gif In case they DO say my car is totaled (KBB value is $8-$9k, I owe $10k)... what should I get next? I'm thinking another xD since I JUST put leather+suede seat covers (they fit better than a glove) in my car that would be silly to basically throw them away with the car... Or get a Honda Fit. No way can I afford an STI at this step in the game called life.

A list of the pricier things they have to replace (just parts) and looking at the 83 item list makes me cry images/smilies/cry.gif

Scion Corp. loves to do things for their car owners who modify their cars, so in 2008 they invited 500 owners with a guest out to a city near Las Vegas, NV for a weekend at 3 different resort hotels. Over the weekend they used our cars for their print advertising and commercials. You can see my car in the xD commercial and the big desert commercial. The compensation for letting them use our cars was staying in $300/night hotel rooms, Flo-Rida and Redman (both ew) on the last night (3 days, 2 nights) and lots of free stuff. There were very few xD's at the event and mine looked the most modified (imho ;p ) so they used mine on the billboards images/smilies/smile.gif 32 cities across the nation images/smilies/love.gif

The woman hit me on the left side. That's why that side is destroyed.

First off, if they go down the "totaled" road, make sure you are using the KBB RETAIL value as a starting point. Not trade in, not private party. Remember, especially since it's not YOUR insurance company, this is entirely a negotiation. (with your own insurance company, you typically sign away your rights to replacement value and just get "cash value" but you have no such agreement with the other company).

So you are entitled to:

* Enough money to replace your car, INCLUDING modifications. The fact that your car was on billboards nationally also represents an significant additional value to the car.
* A rental car for a reasonable period of time (even if they cut you a check, it's not unreasonable to want a couple of weeks to buy your replacement).
* medical expenses, including the time you have to take off for appointments, etc.
* something for your time in general

To repeat, it's a negotiation. You have the upper hand, because if they don't settle, you will take them to court, which costs them time and energy....and they will still pay most of the above even in a most favorable judgment for them (after all, there's no doubt, you are getting money, it's all about "how much").

If they balk at all, hire an attorney. It's amazing how quick their tune changes as soon as you demonstrate any resolve. If you need a SoCal attorney referral I can get you a couple of names.

Thank you for that, I am actually tearing up and starting to panic about this even though I have no idea what's going to happen regarding this. If anything, I'd prefer to get a new xD and move my modifications over to it. Thank god I have my stock tires, stock exhaust, stock springs, stock headunit.

Hopefully it won't come down to needing an attorney for this but since everyone is pinching pennies I won't be surprised if they try to do something.

The best insurance money I ever spent was "rollover" insurance (different companies call it different things). Basically, if I owe $8,000, bt it's only worth $5,000...it doesn't matter what it's worth, because they'll pay it off 100%. I just so happened to have rolled-over my pick-up truck which was on a lease (three weeks left). It was totaled, the insurance company basically "bought" the car, and I got my lease's security deposit back. images/smilies/smile.gif

Ugh.

Ok, they're going to be replacing the tire that was busted with a brand new one. My other three tires have 15k mi on them and are perfectly fine. I'm not keen on having just one new tire in the front but the shop will only fix what was damaged so... yea. Either I let the shop get the one new tire and go get either one new tire for the right side so its the same in the front, or go get all four new tires myself and have the shop give me the money they would've spent for the one tire.

What should I do? So confused! Why the hell did I have to get hit anyways.. images/smilies/mad.gif

You really have my sympathy. I know exactly what it's like to pour a lot of time, money, and effort into a car only to have it ripped away by some other prick who doesn't know how to drive. I also know what a pain in the ass the insurance company can be to deal with.

I'm going to have to pay out of pocket, ~$100, for the other new tire.

Not able to realistically afford a used Audi A3 or A4 because of the pricey up keep images/smilies/sad.gif Maybe a Civic or something.. all depends on how much they offer me for my car and how low they'll go on the new car. Been hearing imports aren't haggling since they know they're in a good spot whereas the American cars are dealing like no other. Argh.

I wasn't involved with the crash, it was my mom and sister. The whole thread covering it is here but here's the short version. The car sat motionless in our driveway for a numbers of years till I decided to see if I could get it running again for my mom. It became my first project car, and I spent a lot of time and money getting it road worthy again. She had it for about a month before that happened, and they both still suffer from the effects of the crash to this day.

That is strange... can't you tell the insurance company to write it off and issue you a check instead? The insurance companies normally want to write off an accident vehicle since it's the easiest option.

So write the car off, buy a new car, move the mods etc (leather seat cover) over to the new car. Job done.
