No, but that doesn't mean some other competing shop should get punished for what the employee did. All because they think the other shop profited from the robbery.
From what I read, McLaren didn't really use the Ferrari information to their advantage. They looked at the weight distribution, saw that it would never work on their (superior) car, so they trashed the idea. Ferrari, and the FIA, have yet to show that McLaren had any sort of advantage because of the docs Coughlan had in his possession. And they've yet to prove that anymore then 3 McLaren personnel were aware of the docs prior to the spygate trial. Even Ron was unaware of the emails Alonso had until Alonso tried to commit extortion with them. But even then Ron reported this to the FIA, even though he still knew nothing about it and believed Alonso was full of... hot air.
In order for Ferrari to have been the "victim", they should have been wronged. But rather then go after the person(s) responsible, they went after a competing team and got them disqualified for the next 2 years. Not to mention Ferrari got the Constructors Title and a big chunk of the McLaren fine money, as a result.
